Frequently Asked Questions
Do I need a lawyer to apply for a green card? You are not required to have an attorney, but immigration law is complex and mistakes can cause serious delays or denials. Having an experienced immigration lawyer on your side means your case is prepared correctly the first time.
How long does the green card process take? It depends on your situation. Adjustment of status cases for immediate relatives of U.S. citizens can take anywhere from 12 to 24 months. Consular processing timelines vary by country and embassy. We'll give you a realistic timeline during your consultation.
What is the difference between adjustment of status and consular processing? Adjustment of status means you apply for your green card while already in the United States. Consular processing means you apply from outside the U.S. through a U.S. embassy or consulate. Which path applies to you depends on where you are and how you entered the country.
Can I apply for a green card if I entered without inspection? Possibly. If you have an immediate relative who is a U.S. citizen, you may qualify for an I-601A unlawful presence waiver. Every case is different — contact us to discuss your specific situation.
What is DACA and can I still apply? DACA (Deferred Action for Childhood Arrivals) provides temporary protection from deportation and work authorization for certain individuals brought to the U.S. as children. As of now, DACA renewals are accepted. New initial applications remain subject to ongoing litigation. If you currently have DACA, renewing on time is critical.
What is TPS? Temporary Protected Status (TPS) is a form of humanitarian protection available to nationals of designated countries experiencing ongoing armed conflict, environmental disasters, or other extraordinary conditions. TPS allows you to live and work legally in the United States while your country's designation remains active.
